These Terms of Use (hereinafter referred to as the "Terms") define the conditions under which the website https://coco-swap.com/ (the "Site") is made available, as well as the conditions of access and use of the Site by COCO SWAP for Users ("you").
The use of the COCO SWAP Site is conditional upon full and complete acceptance of these Terms.
The version of the Terms currently online is the only enforceable version for the entire period of use of the Site until it is replaced by a new version.
These Terms are supplemented by the COCO SWAP General Terms and Conditions of Sale and our Privacy Policy.

We specialize in connecting families for cultural and language exchanges for young people aged 13 to 18 within the European Union and for adults abroad.
What are the conditions of access to the Site?
The Site is accessible at: https://coco-swap.com/
The Site allows you to access the following main services:
- Presentation of our concept on the Homepage,
- Presentation of services for families or adults,
- Presentation of sponsorship,
- Access to an online registration area,
- Access to a contact form.
You may create a User Account. To do so, you must register by completing the registration form. By registering, you agree, on your own behalf and, if applicable, on behalf of your child or family, to provide true, accurate, up-to-date, and complete information concerning your identity and contact details, particularly your email address and age.
In particular, you agree not to use any pseudonym in your email address that could infringe the rights of third parties (including use of someone else’s surname, pseudonym, brand name, or works protected by copyright and/or related rights) for any reason whatsoever. COCO SWAP reserves the right to refuse and/or require correction of such pseudonyms.
More generally, if you provide false, misleading, inaccurate, outdated, or incomplete information, COCO SWAP reserves the right to suspend or permanently deny access to the Site.
To access the Site, you must then log in using your chosen username and password. If you forget them, you will have the option to reset your password.
You must ensure that your password remains secret. Any disclosure of the password, in any form, is prohibited. You bear all risks associated with the use of your username and password. We decline any liability in case of fraudulent use.
The Site is accessible free of charge from anywhere, provided you have internet access. All costs incurred to access the Site (computer equipment, software, internet connection, etc.) are at your expense.
Any event resulting from force majeure causing a malfunction of the Site or servers, or subject to interruption or modification for maintenance, does not engage our liability. In such cases, you agree not to hold us responsible for any interruption or suspension of service, even without notice.
What are the conditions of access for minors?
Registration and access to the Site are possible for minors after COCO SWAP has received authorization from the person holding parental authority.
Any access to the Site and Services or use of the User Account by a minor shall not engage COCO SWAP’s liability.
What personal data do we collect?
We ensure the collection and processing of personal data with respect for privacy, in accordance with Law No. 78-17 of 6 January 1978 relating to information technology, files, and freedoms, and the General Data Protection Regulation (GDPR).

Your image rights
The use of your name and image is necessary to enable connections between families. It is important that each adult or family can discover the other adult or family and their place of residence through photos on the Site.
This is why, when you register, you authorize and guarantee COCO SWAP the right to use your first and last names, your image, and the names and images of your family and children, on a non-exclusive basis, in whole or in part, in any form, and on the Site, for the purposes of providing the matching services offered by the Site.
This right of use includes the right to capture, fix, reproduce, and distribute, directly or through third parties, the images of the User and their family. This authorization is granted free of charge, worldwide, and for the duration of the use of the Services.
The User acknowledges that they will not claim any copyright as a result of using their image as part of the Services provided by the Site. Your name, image, profile photos, and all information on your profile may be used as part of the matching process proposed by the Site, without any compensation being paid to you.
COCO SWAP, the beneficiary of this authorization, undertakes not to exploit the image of the User or their family in any way that could damage their reputation or privacy, including in any pornographic, racist, or xenophobic material, or more generally harm or prejudice them. Conversely, the User agrees not to exploit the image of other adults or families on the Site in any way that could damage their reputation or privacy, including in any pornographic, racist, or xenophobic material, or more generally harm or prejudice them.
Our distinctive elements are protected! (Intellectual Property)
All brands, logos, signs, photographs, texts, comments, illustrations, animated or non-animated images, video sequences, sounds, and all computer applications that may be used to operate the Site, and more generally all elements reproduced or used on the Site are protected by intellectual property laws.
They are the full property of COCO SWAP or its partners. Any reproduction, representation, use, or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of COCO SWAP, is strictly prohibited. COCO SWAP’s failure to initiate proceedings upon becoming aware of such unauthorized use does not constitute acceptance or waiver of prosecution.
The photos or images on the Site are either the property of COCO SWAP, authorized by Users, or royalty-free. Any fraudulent, abusive, or illegal use of the photos or images on the Site is strictly prohibited and may result in legal action.
You must request our prior authorization for any reproduction, publication, or copying of the various contents. You agree to use the content of the Site only in a strictly private context, and any use for commercial or advertising purposes is strictly prohibited.
Any total or partial representation of our Site by any means whatsoever without the express authorization of COCO SWAP SAS constitutes an infringement punishable under Articles L 335-2 et seq. of the Intellectual Property Code.
In accordance with Article L 122-5 of the Intellectual Property Code, the User who reproduces, copies, or publishes protected content must cite the author and source.
Site management
For the proper management of the Site, we may at any time:
- suspend, interrupt, or limit access to all or part of the Site, restrict access to the Site, or certain parts of the Site, to a specific category of Internet users;
- delete any information that may disrupt its operation or violate national or international laws, or the rules of Netiquette;
- suspend the Site to carry out updates or maintenance.
Our liability is limited
The source of the information published on the Site is considered reliable, but we do not guarantee it is free of errors, defects, or omissions. The information is provided for information purposes only and has no contractual value.
The information and content of the Site, particularly the family profiles, are provided by the families themselves. COCO SWAP is not responsible for the accuracy of these profiles.
This information is for informational purposes only. COCO SWAP does not guarantee the quality of relationships between adults or between families and children, or the quality of the exchange conditions in general. In particular, this information does not replace your own judgment. We recommend that you establish a relationship with the other family using all available means: phone, videoconference, email, or face-to-face meetings.
Despite regular updates, we cannot be held responsible for any changes in administrative or legal provisions occurring after publication. Similarly, we cannot be held responsible for the use or interpretation of information on the Site.
We cannot be held responsible for any viruses that may infect your computer or other equipment following use, access, or downloading from our Site, unless COCO SWAP is proven at fault despite all security measures implemented.
Your connection equipment is your sole responsibility. You must take appropriate measures to protect your equipment and data, especially from internet attacks. You are solely responsible for the sites and data you consult.
We cannot be held responsible for any legal action taken against you due to your non-compliance with these Terms.
Our liability cannot be engaged in the event of failure, breakdown, difficulty, or interruption inherent to the internet network or access providers, preventing access to the Site or any of its features, or in the event of force majeure or the unforeseeable and insurmountable act of a third party. Specifically, COCO SWAP shall not be held responsible for any incident, virus, or intrusion (permanent or temporary interruption of service, computer virus, bugs, malware, illicit network intrusion, etc.) that may occur and their consequences.
