Article 1 – Definitions
When used with a capital letter, the following terms have the meanings defined below:
- COCO SWAP: COCO SWAP, a limited liability company with a share capital of €1,000, having its registered office at 41 rue du Sabot - 21130 Auxonne, France, registered with the Dijon Trade and Companies Register under number 939 431 219. COCO SWAP is the company that publishes the Coco Swap website.
- Site: The website published by COCO SWAP, accessible at the following link: www.coco-swap.com
- General Terms and Conditions of Sale or GTCS: These General Terms and Conditions of Sale for COCO SWAP Services.
- Services: The services offered by COCO SWAP through the Site.
- User: Any natural person using the Services under their sole responsibility and who has previously accepted these General Terms and Conditions.
Article 2 – Scope and Modifications
The use of the Services requires full and complete acceptance of the General Terms and Conditions of Sale set out below (hereinafter the "GTCS").
Unless otherwise agreed, the GTCS govern the contractual relationship between COCO SWAP and any User who has registered for one of the "Go", "Go and Host", or "Host Only" offers described in Article 5 below.
These General Terms govern the use of the Services by the User.
To better understand your rights and obligations when using the Services, we invite you to read these General Terms carefully.
COCO SWAP may update these General Terms at any time. The applicable GTCS are those in force on the date of payment when subscribing to a matching package as specified in Article 5.2 below.
As this is a distance contract, COCO SWAP provides its identification details:

These GTCS are supplemented by the Privacy Policy and the General Terms of Use of COCO SWAP ("GTU").
The User may consult the GTCS in the footer of the Site.
Article 3 – General Presentation of Services
Access to the Services allows adults or families to connect in order to organize a cultural and language exchange under three options:
- I go and stay with a host
- I go and I host
- I only host
This mission is strictly limited to matchmaking and constitutes an obligation of means, not an obligation of result. COCO SWAP undertakes to use all necessary means to enable the connection between:
- Two adults wishing to travel abroad and/or host in order to learn a language or discover a culture,
- Or two families wishing to send their child to a host family abroad and, in return, host a child from that family within the European Union exclusively.
COCO SWAP is responsible for the following actions:
- Searching for and selecting adults and families,
- Reviewing application files and making contact,
- Connecting adults, teenagers, or families,
- Providing information to monitor the relationship between adults or families.
COCO SWAP only provides a matchmaking service and does not cover any of the following aspects (non-exhaustive list), which remain the responsibility of the adults or families:
- Relationships between adults, families, and children,
- Booking and purchasing transport tickets,
- Organizing the outward and return journeys,
- Organizing the accommodation and meals,
- Organizing outings and visits during the stay,
- Authorizations or refusals for hospitalization and surgeries for children,
- Consequences of physical or material damage, offenses, accidents, and deaths.
Article 4 – Registration
Registration as an adult or family is free.
Only an adult may register. The User must complete a form (first name, last name, email, phone, referral code, password) and read and accept the GTU and authorize the use of their image rights by ticking the relevant box. The registration is then activated, and the profile appears on the Site as a person who hosts, goes, or both.
If the age provided shows that the User is under 18, registration will be postponed pending receipt of parental consent.
To benefit from the matchmaking services, the family or adult must then be certified. The User will receive an email requesting the necessary documents to finalize the file. Certification is granted upon receipt by COCO SWAP of the complete registration file, including the following documents or equivalents depending on the User's country:
- A copy of an identity document of the adult or parents (ID card or passport),
- A copy of the family record book or court decision granting parental authority,
- Proof of address less than three months old,
- A copy of civil liability insurance valid for the current year,
- An extract from the criminal record (bulletin no.3),
- The GTU signed by the adult or legal guardian,
- Photos of the adult or family, the child, and the home,
- If applicable, parental authorization.
Certification will be refused if the file is incomplete or does not meet the above conditions.
All data provided during registration must be complete, accurate, and up-to-date. COCO SWAP reserves the right to verify this information and request additional documents. In case of any change, the User undertakes to update their profile accordingly.
Article 5 – Matchmaking
Once certified, the User can choose one of the three matchmaking options:
- I go and stay with a host,
- I go and I host,
- I only host.
Article 5.1 – Price of the Matchmaking Service
The Services provided as part of the matchmaking packages are charged at the current rates indicated on the Site at the time of selection by the User. Prices are expressed in Euros, all taxes included.
Article 5.2 – Subscription to a Matchmaking Package and Payment
The subscription to a package is done exclusively via the Site by clicking on the desired option and the "Make a request" button. The User must accept the GTCS by ticking a box and waive their right of withdrawal in accordance with Article 7.
Once the request is validated, the User is redirected to the secure payment provider Payplug or Paypal.
Article 6 – Duration of the Services – Cancellation and Refund
Payment of the selected package entitles the User to one matchmaking within one year from the date of payment.
Voluntary non-use of the Services within this year does not entitle the User to any refund, except in the event of the death of the participant or host before the first exchange, upon presentation of a death certificate.
If the User wishes to benefit from a new matchmaking, they must subscribe to a new package and pay the corresponding fee.
Article 7 – No Right of Withdrawal
In accordance with consumer law, the User is generally entitled to a withdrawal period. However, under Article L221-28, this right does not apply to digital content provided before the end of the withdrawal period when the consumer has expressly consented and waived this right.
The Services offered by COCO SWAP fall under this provision. The User expressly consents to the immediate execution of the Service and waives their right of withdrawal.
Article 8 – User Commitments
The User undertakes to:
- Provide all information necessary for the proper conduct of the exchange regarding the adult, child, family, and residence,
- Describe honestly and accurately their family, child, and home,
- Participate in a video call so that COCO SWAP can evaluate the home,
- Answer all questions and provide the requested documents and photos,
- Maintain the confidentiality of shared data (names, addresses, contact details, health information, photos),
- Comply with applicable laws in their own and the host country.
Article 9 – Warranties
COCO SWAP provides a technical platform for connecting Users but offers no guarantee of results. There is no guarantee that a User will find a corresponding match.
COCO SWAP does not personally know the adults or families and does not visit their homes. COCO SWAP shall not be held liable if the relationship does not meet the User's expectations.
Article 10 – Limitation of Liability
COCO SWAP endeavors to verify information provided by the User by reviewing the file and organizing a video call. It is not possible to visit every home. COCO SWAP is only responsible for the matchmaking itself, not for the actions of adults or host families.
COCO SWAP does not guarantee the accuracy or completeness of the information provided and is not responsible for the safety or consequences of participants' actions.
It is recommended to establish a prior relationship with the other family using all available means (phone, email, in-person meeting).
Article 11 – Customer Service – Complaints
Any questions, complaints, or requests regarding the Services must be sent to:
Any complaint must be addressed to Customer Service before initiating any other procedure in order to seek an amicable solution. COCO SWAP undertakes to do its best to resolve any issue amicably and fulfill its obligations to the User.
Article 12 – Mediation – Online Dispute Resolution
Article 12.1 – Mediation
The User is informed of their right to use free consumer mediation. In accordance with applicable rules, any dispute must first be submitted to Customer Service.

Article 12.2 – Online Dispute Resolution Platform
In accordance with Article 14 of Regulation (EU) No.524/2013, the European Commission has set up an online dispute resolution platform, accessible at the following link:

Article 13 – Waiver
The fact that COCO SWAP does not enforce a clause at any given time does not constitute a waiver of its right to enforce that clause later.
Article 14 – Language of the Contract
The contract can be concluded in French, English, German, Italian, or Spanish. Only the French version of these GTCS is legally binding.
Article 15 – Applicable Law
Any matters not covered by these General Terms, as well as the services they govern, shall be governed by French law, excluding any other law. French law applies subject to any mandatory provisions of the User’s country of residence.
